DRAFT: pending legal review. This text will be reviewed by a lawyer before publication; open points are marked below.
Seller and works: The seller is Arya Kaya. The works on this site are the artist’s own, unique and original pieces. Sales are made directly with the artist by correspondence on WhatsApp, email or the contact form; the site has no cart or online payment. For consumers resident in Turkey, these terms also serve as the pre-contractual information required by the Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
Pre-contractual information: Each work’s title, size, medium, year, status and price are shown on its page. Prices are in Turkish lira; foreign-currency equivalents shown in other languages are approximate and for information only. Tax and invoice details are provided in writing with the order confirmation (the seller’s tax status will be settled with legal and accounting advice).
Order and payment: The contract is formed when the work, price, delivery time and shipping cost are confirmed in writing by both sides (WhatsApp or email). Payment is by bank transfer; account details are shared only with the order confirmation. For commissioned (made-to-order) works a deposit is taken before work begins; the deposit rate and timing of the balance are stated in the order confirmation.
Right of withdrawal: Consumers resident in Turkey may withdraw from the purchase of a work in stock within 14 days of delivery without giving a reason. Withdrawal is notified in writing; the work is returned undamaged and, where possible, in its original packaging; the price is refunded within 14 days of the work reaching the seller. Who bears the return shipping cost will be settled in the legal review. There is no right of withdrawal for commissioned works made to the buyer’s specifications (Regulation art. 15/1-c).
Delivery and shipping: Works are shipped professionally packed and insured. The shipping cost and estimated delivery time are stated in the order confirmation. Large canvases may be shipped stretched or rolled; the method is agreed with the buyer.
International shipping and customs: International shipments are delivered DAP (Delivered at Place): import duties, customs fees and VAT in the destination country are borne by the buyer. Shipping and insurance costs are stated in the order confirmation.
Damage and loss: If the packaging is damaged on delivery, have the courier record it and write to us within 48 hours with photographs; the insurance claim is handled with these records.
Certificate of authenticity: Each work comes with a certificate of authenticity signed by the artist.
Copyright: Ownership of the work passes to the buyer; copyright remains with the artist (Law No. 5846 on Intellectual and Artistic Works). Reproduction or commercial use of the work requires the artist’s written permission.
Disputes: Turkish law applies. For consumer disputes, the Consumer Arbitration Committees and Consumer Courts at the consumer’s place of residence have jurisdiction.
